Processing of (personal) data by the entity in charge of the online application process
We are pleased that you are interested in applying to us. Below, we explain how we process your personal data in the context of an application and provide further relevant information in this regard.
1. Who is responsible for processing your personal data?
attempto GmbH & Co. KG, Hahilingastraße 1d, 82041 Oberhaching (hereinafter referred to as “we”), is the controller within the meaning of the EU General Data Protection Regulation (“GDPR”).

3. For what purposes and on what legal basis do we process personal data?
We process personal data about you for the purpose of your application for an employment relationship, insofar as this is necessary for the decision on the establishment of an employment relationship with us. The legal basis is Section 26 (1) in conjunction with Section 26 (8) sentence 2 of the German Federal Data Protection Act (BDSG).
Furthermore, we may process personal data about you insofar as this is necessary to defend against legal claims asserted against us arising from the application process. The legal basis for this is Article 6 (1) (f) GDPR; the legitimate interest is, for example, an obligation to provide evidence in proceedings under the German General Equal Treatment Act (AGG).
If an employment relationship is established between you and us, we may further process the personal data already received from you pursuant to Section 26 (1) BDSG for the purposes of the employment relationship, insofar as this is necessary for the performance or termination of the employment relationship or for the exercise or fulfillment of rights and obligations arising from a law, a collective agreement, or a works or service agreement (collective agreement) of the employee representation.
4. Which categories of personal data do we process?
We process data related to your application. This may include general personal data (such as name, address, and contact details), information about your professional qualifications and education, details of professional training, or other information that you provide to us in connection with your application.
In addition, we may process publicly available, job-related information about you, such as a profile on professional social media networks.
5. Which categories of recipients receive the data?
We may transfer your personal data to companies affiliated with us, insofar as this is permitted within the scope of the purposes and legal bases set out in Section 3. In addition, personal data is processed on our behalf on the basis of contracts pursuant to Article 28 GDPR, in particular by hosting providers or providers of applicant management systems.
Please note that we use Personio for the application process and for personnel files.
When sent by email, the data is transmitted in encrypted form where supported by the external system (transport encryption). If this level of encryption is not sufficient for you, please use WinZip or 7Zip with password encryption and inform us of the password by telephone.
6. Is a transfer to a third country intended?
A transfer to a third country is not intended.
7. How long will your data be stored?
7.1 Application process
Your data will be stored until the proper completion of the application process and deleted in accordance with statutory retention periods, but no later than after 6 months.
7.2 Applicant pool
You have the option of giving us your consent to store your data beyond the application process described in Section 7.1. With your written consent, we will include your data in an applicant pool in order to remain in contact with you regarding future vacancies in our company over the long term. In such cases, we will send you a consent form by email.
8. What rights do you have?
As an applicant, you have the following data protection rights depending on the individual situation. To exercise these rights, you may contact us or our Data Protection Officer at any time using the contact details provided in Sections 1 and 2:
8.1 Right of access
You have the right to obtain information about the personal data processed by us concerning you, as well as access to and/or copies of this data. This includes information about the purpose of processing, the categories of data processed, the recipients and persons authorized to access the data, and, where possible, the planned duration of data storage or, if this is not possible, the criteria used to determine this duration.
8.2 Right to rectification, erasure, or restriction of processing
You have the right to request the immediate rectification of inaccurate personal data concerning you. Taking into account the purposes of processing, you also have the right to request the completion of incomplete personal data, including by means of a supplementary statement.
8.3 Right to object
If the processing of personal data concerning you is based on Article 6 (1) (f) GDPR, you have the right to object to the processing at any time for reasons arising from your particular situation. We will then no longer process the personal data unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights, and freedoms, or the processing serves the establishment, exercise, or defense of legal claims.
8.4 Right to withdraw consent
If processing is based on your consent, you have the right to withdraw this consent at any time. This does not affect the lawfulness of processing carried out on the basis of the consent prior to withdrawal. You may contact us or our Data Protection Officer at any time using the contact details provided above. Participation in the application process will then no longer be possible.
8.5 Right to erasure
You have the right to request the immediate erasure of personal data concerning you, and we are obliged to erase personal data without undue delay if one of the following reasons applies:

The provision of personal data is neither legally nor contractually required, nor are you obliged to provide personal data. However, providing personal data is necessary for entering into an employment contract with us. This means that if you do not provide us with personal data when applying, we will not be able to establish an employment relationship with you.
